This Rental Agreement is made at ____________ on ________________ BETWEEN ________________, residing at ________________ (hereinafter the “Landlord” / Lessor), of the ONE PART, AND ________________, residing at ________________ (hereinafter the “Tenant” / Lessee), of the OTHER PART.
WHEREAS the Landlord is the lawful owner of the premises described below and has agreed to let the same to the Tenant, and the Tenant has agreed to take the same on rent, on the terms and conditions set out below; NOW THIS AGREEMENT WITNESSETH as follows:
- 1.Demised Premises. The Landlord hereby lets out to the Tenant the residential premises situated at ________________ (Semi-furnished) (hereinafter the "Premises"), together with the fixtures and fittings existing therein, for the Tenant's use and occupation on the terms set out below.
- 2.Term. This Agreement shall be valid for a period of 11 month(s), commencing from ________________ and ending on ________________, unless terminated earlier in accordance with the terms herein. The tenancy may be renewed thereafter by mutual written consent of both parties.
- 3.Rent. The Tenant shall pay to the Landlord a monthly rent of ₹0.00 (Rupees Zero Only), payable in advance on or before the 5th day of each English calendar month. Rent shall be paid by bank transfer or other agreed mode, and the Landlord shall acknowledge receipt on request.
- 4.Security Deposit. The Tenant has paid to the Landlord an interest-free refundable security deposit of ₹0.00 (Rupees Zero Only), the receipt of which the Landlord acknowledges. The deposit shall be refunded to the Tenant at the time of vacating the Premises, after deducting any arrears of rent, unpaid utility charges, and the cost of making good any damage beyond normal wear and tear.
- 5.Notice & Termination. After the lock-in period (if any), either party may terminate this Agreement by giving 1 month(s) prior written notice to the other, or rent in lieu thereof. The Landlord may terminate without notice if the rent remains unpaid for more than fifteen (15) days after the due date, or upon a material breach by the Tenant.
- 6.Use of Premises. The Tenant shall use the Premises for residential purposes only and shall not carry on any illegal, hazardous, or commercial activity therein. The Tenant shall not store any unlawful or dangerous goods on the Premises.
- 7.Maintenance & Repairs. The Tenant shall bear the monthly maintenance / society charges in respect of the Premises. The Tenant shall keep the interior of the Premises and the fixtures in good condition (normal wear and tear excepted). Major structural repairs shall be the responsibility of the Landlord.
- 8.Utilities. The Tenant shall pay, as and when due, all charges for electricity, water, gas, internet, and other utilities consumed at the Premises as per actual meter readings or bills raised by the respective authorities during the tenancy.
- 9.Alterations. The Tenant shall not make any structural additions or alterations to the Premises without the prior written consent of the Landlord. Any permitted fixtures installed by the Tenant at the Tenant's cost may be removed on vacating, provided the Premises are restored to their original condition.
- 10.Subletting. The Tenant shall not sublet, assign, or part with possession of the whole or any part of the Premises to any third party without the prior written consent of the Landlord.
- 11.Inspection. The Landlord or the Landlord's authorised agent may, on reasonable prior notice and at a mutually convenient time, enter and inspect the Premises to verify their condition and compliance with this Agreement.
- 12.Handover on Vacating. On expiry or earlier termination of this Agreement, the Tenant shall peacefully hand over vacant possession of the Premises to the Landlord in the same condition in which it was handed over, normal wear and tear excepted, along with all keys and access devices.
- 13.Stamp Duty & Registration. This Agreement shall be stamped and, where required by applicable law, registered with the appropriate authority. The cost of stamp duty and registration shall be borne by the parties as agreed between them or as required by local law.
- 14.Governing Law & Jurisdiction. This Agreement shall be governed by and construed in accordance with the laws of India. The courts at ________________ shall have exclusive jurisdiction over any dispute arising out of or in connection with this Agreement.
